The newspaper article I have said this, "Death by Chocolate" was created in the Highlands store in Louisville by Chef Christopher Paul Dowell. He also says that the equities successful recipes I've seen it in other shops Louisville area. Perhaps you have tried it.

The name "Death by Chocolate" is much used in desserts. Their is an entire cookbook by Marcel Desaulniers called Death By Chocolate (and it is wonderful!). Thus it is possible that you have had a different dessert with this name. In Desaulniers Cookbook "is the title of a cake for dessert.
